DMCA copyright and takedown policy

This DMCA policy explains how to ask LadyBoy.net to remove content that infringes your copyright, how a member can respond with a counter notice, and what happens to accounts that infringe repeatedly. Notices go to [email protected].

1. Our approach

LadyBoy.net respects the rights of creators and of everyone else who owns content. We respond to notices of alleged infringement that meet the requirements of the Digital Millennium Copyright Act (17 U.S.C. 512) and similar laws in other countries. Many of our creators are also victims of content theft, so we treat these notices seriously in both directions.

2. How to send a takedown notice

Send your notice by email to [email protected] with the subject line "DMCA notice". The notice must include all of the following:

  1. Your physical or electronic signature, as the copyright owner or as a person authorised to act for the owner.
  2. A description of the copyrighted work you say has been infringed. If several works are covered, a representative list is enough.
  3. The exact location of the material on LadyBoy.net, such as the profile address, post link or shop item link, so that we can find it.
  4. Your contact details, including your name, email address and, where you have one, a postal address or phone number.
  5. A statement that you believe in good faith that the use of the material is not authorised by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act on the owner's behalf.

Notices that leave out required elements may not be actionable. We may ask you for the missing information before we act.

3. What happens after a valid notice

When we receive a complete notice, we remove or disable access to the material, usually within a short time. We tell the member who posted it, pass on a copy of the notice with your personal contact details reduced to what the law requires, and record the notice against the account.

4. Counter notices

If your content was removed and you believe it was a mistake or that you have the right to use it, you can send a counter notice to [email protected] with the subject line "DMCA counter notice". It must include:

  1. Your physical or electronic signature.
  2. A description of the material that was removed and where it appeared before removal.
  3. A statement under penalty of perjury that you believe in good faith the material was removed as a result of a mistake or misidentification.
  4. Your name, email address and a postal address, and a statement that you consent to the jurisdiction of the courts for the district where you live, or if you live outside the United States, any judicial district in which the service may be found, and that you will accept service of process from the person who sent the original notice or their agent.

We send a copy of a valid counter notice to the person who filed the original notice. If that person does not tell us within 10 to 14 business days that they have filed a court action to restrain the use, we may restore the material.

5. Repeat infringers

Accounts that receive repeated valid notices are closed. In general, a third valid notice against an account leads to permanent closure, and we may close an account sooner where the infringement is deliberate or large in scale, such as uploading stolen creator content. Creators whose accounts are closed for infringement lose access to their feed and shop, and earnings connected to infringing content can be withheld.

6. Help for creators whose content is copied

If your LadyBoy.net content appears on another site, every file you publish here carries a watermark linked to the subscriber who viewed it, which helps identify the source of a leak. Write to [email protected] with the link and we tell you which details to include in a notice to the other site.

7. Misuse of this process

Sending a notice or counter notice that knowingly misrepresents facts can make you liable for damages under 17 U.S.C. 512(f). Do not use this process for complaints that are not about copyright. Safety issues, impersonation and content that breaks our content policy belong on the report page.

8. Contact

All copyright matters go to [email protected]. We do not accept notices through forum posts or direct messages. See our terms for the rest of the rules that apply to content on LadyBoy.net.
